A Dhaka court today has ordered to croak the assets of Evaly Managing Director (MD) Mohammad Russell and chairman Shamima Nasreen in the check fraud case. Dhaka Additional Metropolitan Magistrate Tofazzal Hossain’s court gave this order, informed the plaintiff’s lawyer HM Al Amin on Thursday.
HM Al Amin said that on October 24, the lawyer of the plaintiff appealed to croak the property of the defendants. The court granted the petition and ordered to croak their property. The court has fixed November 16 for submitting the report.
According to the case source, on January 23, 2021, the plaintiff in the case named Mehdi Hasan Khan ordered three motorcycles, a mobile phone and some gift cards and paid Tk 854,000 through mobile banking after seeing an advertisement. However, the defendants failed to deliver the goods within a specified period of 45 days.
Then on March 9, Evaly issued a check for the equivalent of the goods. The check was dishonored when it was deposited in the bank on July 5. A legal notice was sent to them on October 14 in this regard. Later, the plaintiff sued Mohammad Russell and Shamima Nasreen.
On this day, the court issued a summons for the accused to appear. However, as they did not appear, the court issued an arrest warrant on February 1 last year.
After the arrest warrant, the court ordered to croak their property as the report was not received within the fixed date.
